(National Sentinel) Endless: Special counsel Robert Mueller told President Donald J. Trump’s legal team that he remains under investigation but that Mueller does not consider him a criminal subject at the moment.
As reported by The Washington Post, three sources familiar with the case said that during private negotiations in early March regarding a possible interview with Trump, Mueller described the president as a subject of investigation into alleged collusion with Russian meddling in the 2016 election.
Someone who is a subject of an investigation may have engaged in conduct that is being probed but no evidence exists to bring charges, the Post reported.
The paper also reported:
The special counsel also told Trump’s lawyers that he is preparing a report about the president’s actions while in office and potential obstruction of justice, according to two people with knowledge of the conversations.
Mueller reiterated the need to interview Trump – both to understand whether he had any corrupt intent to thwart the Russia investigation and to complete this portion of his probe, the people said.
Under rules governing special counsels, Mueller is required to report his findings confidentially to Deputy Attorney General Rod Rosenstein, who then decides whether to release the report to the public.
“They’ve said they want to write a report on [the issue of obstruction] – to answer the public’s questions – and they need the president’s interview as the last step,” one person familiar with the discussions said of Mueller’s team.
Earlier, former U.S. attorney Andrew McCarthy said that Mueller cannot plausibly charge Trump with obstruction.
Referencing a text FBI lawyer Lisa Page sent her lover, FBI agent Peter Strzok, that President Obama “wants to know everything we’re doing” in terms of the counterintelligence investigation into Team Trump, McCarthy said presidents are supposed to know what is going on during counterintelligence probes, which is what the Trump spying case was.
“Your play here is not that Obama is a liar. It is that the president is supposed to ‘interfere’ in intelligence investigations. That makes the Trump-Russia obstruction narrative patently absurd,” he wrote.
He further noted that former FBI Director James Comey told Trump on more than one occasion he was not the subject of a criminal probe.
That said, McCarthy noted in December he believes Mueller is conducting “an impeachment investigation.”
Trump’s legal team has experienced shake-ups in recent weeks, with lawyers clashing mostly over strategy regarding his decision to sit down and talk to Mueller.
