DiGenova: ‘We’re headed for a constitutional crisis’ if Mueller subpoenas Trump over ‘witch hunt’ Russia probe

(National SentinelCollision Course: Former U.S. attorney Joe diGenova said Monday that if special counsel Robert Mueller attempts to subpoena President Donald J. Trump as part of his endless Russia collusion and obstruction of justice probe, a “constitutional crisis” will ensue.


In discussing who may have leaked a set of questions to The New York Times that allegedly came from Mueller, diGenova told Fox News‘ Laura Ingraham that he really isn’t concerned about who leaked them, but that he’s more focused on Mueller’s intentions.

“I actually don’t care who leaked” the questions, diGenova — a frequent critic of the Mueller probe — said.

“I think what’s important is that these are clearly the types of questions that have been discussed between the president’s team and Mr. Mueller.

“And the question is, ‘What do these questions say?'” he continued. “They say that the investigation is now lurching into territory protected by the constitutional privileges by the president of the United States.

“Let’s assume these questions are accurate,” diGenova explained, “that this is what Mueller wants to ask. If they are, and if he insists on answers, and will not accept written answers and demands and interview, which the president rejects, and then Mueller insists on a subpoena, we are headed to a constitutional crisis.”

DiGenova went onto say that Trump isn’t going to answer those questions “under any set of circumstances.”
