(National Sentinel) First Amendment: The tactical decision by Senate Majority Leader Mitch McConnell, R-Ky., to leave open the late Justice Antonin Scalia’s seat was a brilliant decision that does not get enough attention.
It allowed POTUS Donald Trump to appoint a rock-solid constitutionalist, Neil Gorsuch, to the high court and that appointment is paying dividends.
After a slew of ‘conservative’ decisions by SCOTUS, the nation’s highest court handed down another this morning dealing a massive blow to authoritarian unions that cost consumers and taxpayers far too much money.
In a 5-4 decision, the court ruled that state government workers cannot be forced to pay “fair share” fees to support collective bargaining and other union interests.
Justice Neil Gorsuch was the deciding vote. Before he was appointed, the court was locked 4-4.
This decision is huge for the First Amendment, Obama’s second SCOTUS appointment, the far-Left Justice Elena Kagan — who was never a judge but who’s ‘claim to fame’ was kicking military recruiters off of Harvard University’s law campus — is ticked off.
She claims the decision “weaponized the First Amendment.”
As noted by Reuters:
In a dissent, liberal Justice Elena Kagan wrote that the ruling gave scant regard to the court’s usual way of evaluating when to overturn a long-standing precedent.
“There is no sugarcoating today’s opinion. The majority overthrows a decision entrenched in this nation’s law – and in its economic life – for over 40 years. As a result, it prevents the American people, acting through their state and local officials, from making important choices about workplace governance,” Kagan said.
The court’s conservative majority, Kagan said, was “weaponizing the First Amendment” to intervene in economic and regulatory policy.
Oh, well, if she’s reading “forcefully” then, by all means, let’s reconsider the majority’s opinion! Forcefully!
Kagan isn’t the only Alt-Left justice who threw a tantrum this week. So did Obama’s first libtard nominee, Justice Sonia Sotomayor.
She ranted on Tuesday for about 20 minutes over the high court’s upholding of POTUS Trump’s authority to impose a travel ban on countries known to harbor terrorists. The fact that they’re “Muslim-majority” is meaningless and had no bearing whatsoever on any of the three orders Trump wrote on the issue.
The law is as clear as it gets on the issue: Presidents can ban anyone for any reason from entering the U.S. if he determines doing so is in the national security interest of the country. The liberal judges in the much-overturned 9th District were the ones who were wrong in using Trump’s campaign rhetoric as the basis for overturning his bans.
“Ultimately, what began as a policy explicitly ‘calling for a total and complete shutdown of Muslims entering the United States’ has since morphed into a ‘Proclamation’ putatively based on national-security concerns,” she railed.
“But this new window dressing cannot conceal an unassailable fact: the words of the President and his advisers create the strong perception that the Proclamation is contaminated by impermissible discriminatory animus against Islam and its followers.”
So, Sotomayor’s a mind reader too?
One more thing: There are no “conservative” or “liberal” justices on the Supreme Court: There are only strict constitutionalists and those who believe they have been given a mandate to interpret our founding document anyway they want — or ignore it altogether.
Update: Justice Anthony Kennedy has announced he will retire from SCOTUS. While his retirement was expected in some circles, so, too, is far-Left Justice Ruth Bader-Ginsburg, who is older than Kennedy. Kennedy’s retirement gives POTUS Trump another opportunity to reshape the high court and ensure the Constitution survives. If he gets to replace another lib justice, that’ll be even better.
