Alan Dershowitz: NO evidence of a crime on Cohen-Trump tape

(National SentinelYawner: The Left-wing media and commentariat were hysterical — again — last week after fake news central, CNN, reported on a tape allegedly containing ‘evidence’ of a criminal act involving POTUS Donald Trump and his former lawyer Michael Cohen.

On Tuesday the network published the audio of a secretly-recorded conversation between Cohen and then-GOP nominee Trump as they discussed, allegedly, a payoff involving a former Playboy playmate who claims to have had an affair with The Donald (which he has vehemently denied).

Cohen’s lawyer, long-time Clinton associate Lanny Davis — who did damage control throughout Bill Clinton’s presidency regarding various allegations of sexual misconduct — claimed that Trump wanted Cohen to pay her off in cash.

The president’s lawyer, Rudy Giuliani, says that’s not at all what the tape indicates: POTUS Trump was instructing his double-crossing lawyer to pay with a check (so there would be a record of the transaction).




Alan Futerfas, a lawyer for the Trump Organization, also refuted that the tape shows Trump was offering a cash payment.

“Whoever is telling Davis that cash in that conversation refers to green currency is lying to him,” Futerfas told CNN.

“There’s no transaction done in green currency. It doesn’t happen. The whole deal never happened. If it was going to happen, it would be a payment to a large company that would obviously be accompanied by an agreement of sale. Those documents would be prepared by lawyers on both sides,” he added.

On Saturday during an appearance with Fox News‘ Judge Janine Pirro, liberal constitutional law professor Alan Dershowitz said there is no indication of a crime on the tape — and he can prove it.

When the subject of the Trump-Cohen tape came up, the Harvard professor focused on whether or not, as Trump attorney Rudy Giuliani claimed earlier, the tape was “played around” with, stating that the tape should be “subjected to forensic analysis” to find out what exactly was said.

“We must stretch the words to find what out exactly what the president said, what the context was, and most of important why it ended at a particular point,” said Dershowitz. “Was that a decision made by Mr. Cohen to end it there? Was it erased because he said things that were exculpatory? We need to know the entire context of the tape if the tape means anything.”

He then explained why he knows there is no evidence of a crime on the tape.

“The tape does not contain any evidence of crime,” said Dershowitz.

“How do I know that? A former judge, appointed by Judge Kimba Wood, made a determination that this tape is covered by the lawyer-client privilege. And criminal discussions are not covered by the lawyer-client privilege.

So we already have a judicial determination that this tape does not contain elements of a crime,” he concluded.

Game, set, and match.

Cohen is grasping at any straw he can in order to keep from being prosecuted by the Justice Department. He will say and do anything, including fabricating some nefarious charge against a man who once trusted him with everything.
