(National Sentinel) Tone deaf: Have you ever been in a roomful of people and told a joke that only you thought was funny? Do you remember how that felt being the only one who got it — that lonely, want-to-disappear wish-I’d-never-said-it feeling?
Supreme Court Chief Justice John Roberts is probably feeling that way about now. Or he should be.
Earlier, POTUS Donald Trump criticized U.S. District Judge Jon Tigar of the uber-liberal 9th Circuit Court for his order blocking enforcement of executive changes to asylum rules to prevent migrants who cross illegally into the U.S. from being able to stay in the country.
Calling Tigar an “Obama judge,” POTUS said Tuesday, “I think it’s a disgrace when every case gets filed in the 9th Circuit. That’s not law, that’s not what this country stands for. Every case that gets filed in the 9th Circuit, we get beaten and then we end up having to go to the Supreme Court, like the travel ban, and we won.
“This was an Obama judge,” he added. “And I’ll tell you what, it’s not going to happen like this anymore.”
That statement rankled the chief justice. In a rare rebuke of the president, he told The Associated Press Wednesday, “We do not have Obama judges or Trump judges, Bush judges or Clinton judges, What we have is an extraordinary group of dedicated judges doing their level best to do equal right to those appearing before them. That independent judiciary is something we should all be thankful for.”
Well, we can’t print the word that best describes Roberts’ statement so we’ll just publish the letters: BS.
Every federal judge selected by presidents based on political considerations.
Obama appointed as many radical Left-wing activists to the federal bench as he could (Tigar) being one of them. We explained yesterday why he is a judicial activist and did not rule on the constitutional merits of POTUS Trump’s executive order.
POTUS Trump is making similar political decisions in who he is nominating to the Supreme Court and the federal courts. He is using a different set of parameters than Obama — Trump’s judges are constitutionalists (which is what all federal judges are supposed to be) — but it’s a political consideration nonetheless.
And yes, Bush, Bush, Clinton, Reagan, and every other president in the modern era has appointed justices and judges using political criteria.
But who made such appointments political in the first place? The Left, of course, and with one litmus test: Who would uphold the right to murder babies in the womb and who would not?
All of the insane Left’s opposition to Justice Brett Kavanaugh’s appointment was based on their belief that he will be part of the “conservative” majority that will eventually overturn the Roe v. Wade decision that overturned anti-abortion laws in all 50 states when it was issued in 1973.
In fact, is Roberts really oblivious to the fact that the media and elected leaders refer to justices as “conservative” or “liberal” in the first place? Because aren’t justices’ decisions based largely on the political positions taken by liberals and conservatives on any given issue?
Given the absurdity of rulings against POTUS Trump’s executive orders coming from federal courts — one judge in Maryland blocked one of his travel bans for something candidate Donald Trump said on the campaign trail! — there is no other way to view such decisions as anything but political.
For Roberts to claim that justices and judges are not political is really the epitome of being tone deaf. Sure, he wants to protect the independence of the Judicial Branch and the federal court system, but can’t he at least do so with a much more credible argument?
