A federal judge has tossed out a lawsuit filed by two Pennsylvania boys and an environmental group against POTUS Donald Trump over he rolled back environmental regulations because he said the Constitution doesn’t guarantee them a due process right to a “life-sustaining climate system.”
Reuters reported that U.S. District Judge Paul Diamond in Philadelphia disagreed with a judge overseeing a similar case in Oregon, noting that there is no legal standing for the boys and the Clean Air Council to sue the president.
In addition, Diamond also said the boys, who were 7 and 11 when the suit was filed in federal court in November 2017, were not able to trace their severe allergies and asthma to Trump administration policies.
As such, they had no standing to sue the president, Energy Secretary Rick Perry, former Environmental Protection Agency Administrator Scott Pruitt, and other defendants named in the suit who moved to have it dismissed.
“Plaintiffs’ disagreement with defendants is a policy debate best left to the political process,” wrote Diamond, an appointee of President George W. Bush. “Because I have neither the authority nor the inclination to assume control of the Executive Branch, I will grant defendants’ motion.”
Joseph Minott, the council’s executive director, said the plaintiffs are going to review legal options because the White House’s ongoing and alleged “deliberate indifference” to climate change increases “the frequency and intensity of its life-threatening effects.”
Despite mainstream media (MSM) reports that “97 percent of scientists agree” that humans cause global warming, there has never been a single legitimate study done proving the theory. Rather, climate scientists rely on computer models to make predictions, and those are neither accurate thus far nor replicable.
Notes Investors Business Daily: “Greenpeace co-founder Patrick Moore has said there “is no scientific proof that human emissions of carbon dioxide are the dominant cause of the minor warming of the Earth’s atmosphere over the past 100 years,” while science writer Michael Fumento wrote convincingly three years ago that proof of global warming was evaporating.”
