Blatant LIES: ‘Mainstream’ media blames Kirstjen Nielsen for enforcing ‘child separation’ policy ordered by liberal court DECADES ago

By Jon Dougherty

Now that Department of Homeland Security Secretary Kirstjen Nielsen has been forced out by the Trump administration, the Leftist “mainstream media” is moving in for the kill shot in order to permanently stain her reputation and forever brand her as POTUS Donald Trump’s ‘border Nazi’ who ‘caged children.’

CNN‘s resident “legal analyst” toadie, Jeffrey Toobin, pronounced that Nielsen will be ‘forever known’ for putting migrant children “in cages.”

“Kirstjen Nielsen, I think, is a great example of what happens when you go to work for Donald Trump,” Toobin said. “He is the great reputation killer. Here is this woman who was a reasonably admired bureaucrat. For the rest of her life people will look at her and think, ‘Oh, that’s the woman who put children in cages.’”

Trump is the ‘reputation killer.’ Right. Try rank Left-wing pundits like Toobin and the rest of the garbage mainstream media; they are the ones destroying Nielsen’s reputation.

House Speaker Nancy Pelosi (D-Calif.) joined in too.

“It is deeply alarming that the Trump Administration official who put children in cages is reportedly resigning because she is not extreme enough for the White House’s liking,” said Pelosi.

“The president’s dangerous and cruel anti-immigrant policies have only worsened the humanitarian suffering at the border and inflicted vast suffering on the families who have been torn apart,” Pelosi said.

The outgoing DHS chief repeatedly pushed back against this blatant and cosmically irresponsible lie for much of her nearly two-year tenure at the helm of DHS. In congressional hearings and on cable news programs, she said time and time again that no, Border Patrol, ICE, and Customs and Border Protection agents were not putting “kids in cages.”

But do you know who did? That would be the Obama administration, as evidenced by 2014 photographs broadcast and reported by none other than…CNN.

There’s more.

Nielsen has also been saddled with the lie that she and POTUS Trump created the “family separation” policy.

The Obama administration, the Bush administration all separated families,” she noted last year. “They absolutely did.”

She’s absolutely right. In fact, Trump ended it after the pathetic Leftist media made an issue of it beginning last year as a means of furthering the lie that he’s a racist and a bigot.

Where did this policy come from, you ask? It was codified into law thanks to the most liberal federal circuit court in the land, the 9th, via the 2015 “Flores settlement,” which was also supported by that bastion of Left-wing legal fights, the ACLU.

This ruling created the family separation policy at the U.S.-Mexico border — not Donald Trump and Kirstjen Nielsen.

Conservative Daily News noted:

In 2015, the plaintiff class in Janet Reno v. Flores moved to enforce the Flores Consent Decree of 1997 after the government asserted in 2014 that the decree only required the removal of unaccompanied minors from detention facilities as quickly as possible. The court, in Flores v. Loretta Lynch, sided with the plaintiff and held that the decree required the government to remove both accompanied and unaccompanied minors from detention facilities within a short period, which is now considered 72 hours.

The finding had an unintended set of consequences. Either the government had to be able to process any immigration/asylum case within the 72-hour period or the children would need to be moved to a “licensed, non-secure facility” that “meets high standards”. The result is that any case where the alien adult’s case was unable to be adjudicated within 72 hours would result in the separation of the child from the adult detainee.

The Obama administration decided to release both the suspected criminal alien and the accompanied minors into the United States pending trial to satisfy the court decision although the action failed to enforce U.S. law. Less than 10% of those released bother to show up for their court dates.

The lax enforcement resulted in a massive influx of Central American immigrants with children in tow and they tend to have no documentation making familial bonds difficult to ascertain.

Nielsen has also been criticized by the same Toobin-like toadies for enforcing POTUS Trump’s “zero-tolerance” policies at the border, which effectively means all immigration laws — including the legal requirements established under the Flores settlement:

This basically creates the situation where, if immigration laws are enforced and these decision adhered to, the minor must be moved to a non-secure, licensed facility, but the parents will remain in a secure detainment facility awaiting trial. That is where the separation of illegal alien families originates – a legal agreement during the Clinton administration and a court decision during Obama’s term. Only Congress can make a law or set of laws to remedy this.

And when POTUS Trump moved to end the policy, even Left-wing Vox lamented that he could get into legal hot water if he did it via executive order….because of the Flores settlement of 1997.

“Getting rid of the requirement to let kids out of immigration custody quickly will take more than a stroke of the pen,” the site noted.

The Left whines that the 1997 agreement and subsequent policies provide the government with some placement options for children. That’s true. But where to put them if not in government facilities?

They complain that the zero tolerance policy overturns decades of the federal government essentially looking the other way when adult migrants enter the U.S. illegally. That’s true. But Trump has always stressed full enforcement of all immigration laws; breaking into the United States is a crime, and when you commit a crime, you get arrested.

When migrants who are caught with children sneaking into the country, they are sent to jail and the kids are ‘separated.’ Obama did this too; so do Bush.

To pin this on Nielsen (and by default POTUS Trump) is not just wrong and irresponsible, it is dishonest to the point of shocking.

President Trump needs to use his monstrous bully pulpit to correct this record, as a service to a loyal Cabinet member now departing, and by doing so exposing the Leftist Toobin-like charlatans (again) in the establishment media.
